BamaCarry Inc. and most conservative gun owners support two of these bills and oppose three of them. We encourage everyone to read the bills and support the ones that are recommended and oppose the ones that we do not support.

SB3 – Constitutional Carry Bill.This bill does NOT do away with permits or the ability to get one. There are a lot of reasons someone will want to continue to get one. This bill removes the REQUIREMENT to get one to carry concealed or to carry in your vehicle.

SB27 – Exempts qualified retired law enforcement officers from firearm restrictions
Under existing law, a person, including a person with a valid pistol permit, is prohibited from possessing a firearm in certain designated places, including law enforcement stations, jails, mental health facilities, courthouses, and athletic facilities. A person, including a person with a valid pistol permit, is prohibited from possessing a firearm in a building or facility to which access is limited by security measures. These prohibitions do not apply to a law enforcement officer in the lawful execution of his or her duties. This bill would also provide that the prohibitions would not apply to a qualified retired law enforcement officer as defined in the federal Law Enforcement Officer Safety Act of 2004. Under the federal definition, a qualified retired law enforcement officer among other requirements has to be honorably retired with 10 or more years of service and meet the qualification for active law enforcement officers to carry firearms.

** BAMACARRY OPPOSES THIS BILL **
There is a big difference between the existing exemption of “a law enforcement officer in the lawful execution of his or her duties” and the proposed additional exemption of “a qualified retired law enforcement officer”. This bill would seek to create another ‘class’ of person eligible to carry a firearm in restricted locations where law-abiding citizens can not carry.

HB108 – Add requirement of a color ID picture to permit and adjust cost to cover expense
Under existing law, there is no requirement for a concealed pistol permit to contain a color, laminated identification photograph of the permittee. This bill would require all future concealed pistol permits issued to contain a color, laminated identification photograph of the permittee. This bill would allow the sheriff to reasonably adjust fees associated with the production of concealed pistol permits under this section.

** BAMACARRY OPPOSES THIS BILL **
The current statute says the Secretary of State will prescribe the form of the permit. This language has been in place since 2013 with no uniform permit. The additional concern of BamaCarry is the language, “The sheriff may reasonably adjust fees commensurate with the production costs of concealed pistol permits under this section.” Who determines what “reasonably adjust” means? This would open the permit process to possible corruption at the expense of law-abiding citizens who obtain a pistol permit.

SB113 – Specifies that sheriffs may not place conditions or requirements on the issuance of a pistol permit
Under existing law, the sheriff may issue pistol permits to eligible applicants. This bill would clarify that, except as expressly provided, a sheriff may not place conditions or requirements on the issuance of a pistol permit, or limit the scope or applicability of the law regarding the issuance of a pistol permit to an eligible applicant. This bill would also provide that a sheriff may not place a time constraint requirement on the taking possession of an approved pistol permit.

HB34 – Adds exemptions for a person using force in self-defence at a church
This bill would provide that a person is not criminally liable for using physical force, including deadly force, in self-defense or in the defense of another person on the premises of a
church under certain conditions.

** BAMACARRY OPPOSES THIS BILL **
This bill is redundant as Section 13A-3-23(b) already says, “A person who is justified under subsection (a) in using physical force, including deadly physical force, and who is not engaged in an unlawful activity and is in any place where he or she has the right to have no duty to retreat and has the right to stand his or her ground.” and (d)(1) says, “A person who uses force, including deadly physical force, as justified and permitted in this section is immune from criminal prosecution and civil action for the use of such force, unless the force was determined to be unlawful.”
